Strict liability provides that for some offences there need not be mens rea as to part of the actus reus, therefore imposing liability even when the accused lacks the mens rea for the whole actus reus. This was illustrated in the case of R v Prince (1875). The defendant was charged with taking a girl under 16 out of the possession of her father. He mistakenly believed she was 18 years old. The defendant had intended to remove her from her father's custody and as the offence was strict liability he was found guilty. The majority of strict liability offences in English law are statutory offences; the task of identifying them is normally a question of statutory interpretation.
