Tort -Unit 2 Tort in law is a wrongful act for which someone can be sued for damages in a civil court. It includes such acts as libel, injury done to someone (whether intentionally or by negligence), and inducement to break a contract. If someone is careless and causes harm or loss to another it does not mean he can sue. The injured person must prove the following three features in order to establish negligence: there must be a duty of care, a breach and causation: the defendant must owe a duty of care to the injured person. If an injury is foreseeable by a reasonable person then this creates a duty for the defendant to take reasonable care to prevent the injury occurring.
