I. INTRODUCTION 1.1) What is strict liability? Offences of strict liability are those crimes which can be committed in which no mental state or mens rea is necessary regarding to at least one aspect of actus reus. The defendant need not have intended or known about that circumstances or consequence. Liability is said to be strict with regard to that element.1 For a good example compare the following contrasting cases. In R v Prince2 ,the defendant was charged under s55 of the Offences against the Person Act (OAPA) 1861 (now s20 of the Sexual Offences Act 1956) that he intended to take the girl out of the possession of her father. The defendant was found guilty because it was sufficient to show that he intended to take the girl out of the possession of her father and knowledge that the girl was under the age of 16 was not required...
