"Negligence is the breach of a legal duty to take care which results in damage undesired by the defendant to the plaintiff". For the tort of negligence, three elements must be shown, which are, the defendant owed the plaintiff a duty of care; the defendant has breached the duty; and as a result, the plaintiff suffered damage which is not too remote. In the case, there are total five people involved in the case. Julius Caesar So, who drove the company van very fast and went through a set of traffic lights with red, caused the accident; Cupid Koo, Julius's colleague who Julius was accompanied during the drive without wearing a seat belt, sustained multiple bodily injuries and broke his arm; Antonio Ho, a pedestrian who was crossing the road at the pedestrian crossing, was collided...
