In order to discuss the development of the British Constitution following the Factortame case, it is first essential to state the outcome of the case. It is then necessary to establish the purpose of a constitution. By doing this, we can analyse the impact of the case on the constitution towards or away from this intended purpose. As such, this case will have had either a positive or negative effect on our constitution. The present state of the British Constitution will thus also need to be included in the discussion to show where the development is originating. The impact that this case had on our constitution was it allowed courts to override national legislation if necessary to enable temporary relief to be granted in protection of rights under Community law.
