In order to critically analyse the impact of the decision in the House of Lords in Street v Mountford1, it is vital to understand the decision given by Lord Templeman. The facts of this case are: Mr Street granted to Mrs Mountford the right to occupy two rooms by a form of agreement described as being a 'licence.' The agreement was subject to a number of conditions, one of which requires Mrs Mountford to sign a declaration which stated, "I understand and accept that a licence in the above form does not and is not intended to give me a tenancy protected under the Rents Act." Mr Street also sought an order of the county court declaring that the agreement was a licence and did not constitute a tenancy.
