Introduction The modern international law doctrine of jus cogens asserts the existence of fundamental legal norms from which no derogation is permitted. It imports universally application applicable norms into the international legal process1. In this way jus cogens is a way of guarding fundamental values of the international community2. . However , simple this concept might appear in the literature, the reality of the doctrine is far from straightforward. Therefore an examination of the emergence of jus cogens in the the international law arena is necessary to fully appreciate its concept and its true significance within the international legal system.
