However, it seems abundantly clear that regulation can exist to regulate war, however, the efficiency of such rules will always be doubtful and this is an inherent problem of any form of regulation. The fact that the majority do not comply with a certain rule does not render such rule as non-existing, but merely as incompetent. War is a reality that is not more than 'a mere continuation of policy by other means'2, therefore regulating war should aim to
