(13 marks) The principles of Horizontal and Vertical direct effect, is based on the principles on directives. Directives are the main way by which the harmony is formed across the whole of the EU (European Union), directives are drafted up covering almost everything ranging from banking,company law, equal rights, the list goes on! However when a directive is issued to a Member state which it is binding on, it can be issued in one of the two ways, either with direct effect or in-direct effect. Direct effect is an important phenomenon that gives individuals the power to claim rights conferred directly by EU treaties, regulations, decisions and directives (after their effective date) even if their member states have failed to introduce them into domestic law (Frankovitch case) or have not implemented them correctly (Factortame case).
