This question involves an evaluation of the manner by which the courts have managed to regulate the law of trusts with regard to the interests of beneficiaries prior to the Trustee Act 2000 and its impact at present. The importance in this essay is that here we are dealing with the idea that a trust should be administered in the 'best interests' of the beneficiaries. Significant questions arise when we mention this phrase with regard to the way trusts are administered, let alone in any other branch of the law.
