It could be said that this sentence probably reflects what the contracting states had in mind when ratifying the European convention of Human Rights in November 1950, following the worldwide reaction towards the committed atrocities during the recent second world war .Nowadays, 50 years later, giving an account of its effectiveness, it seems that the convention has managed to protect basic freedoms and to affect to a certain degree the national law system of each contracting state. One of the most frequently violated articles of the convention is article 3, especially in its first years of existence, not only by individuals, as it one would expect, but also by States.
