Law Equity Essay a) What are the historical reasons for the development of equity? The development and introduction of equity started because of the common law system not being perfected. If the common law system had been perfected equity would not have been developed. The common law was a system where the judge of a case would look back on previous cases to decide the outcome of the current case. In this system the judge has to follow precedents laid down in the previous cases. The outcome of this system is a whole catalogue of case decisions. The result of following these precedents for centuries has created a 'framework' of law, which alone is capable of operating without statute (to a limited degree).
