Trial by jury has existed for more than six hundred years, since Magna Carta, in 1215, however there has been no clear attitude towards the principle of trial by jury in the English or American constitutional law. Juries in criminal cases and others are expected to judge what the facts are, what the law is, and what the moral intent of the accused was. However there have been arguments to suggest that there should be a restriction of trial by jury.
