There have been several court cases throughout the history of the United States that have become landmarks in the nation. Two of these, Marbury v. Madison and McCulloch v. Maryland, took place early in the 19th century, while independent America was still embryonic. The first of these cases, Marbury v. Madison, established one of the most important policies of the Supreme Court: judicial review. The other case, McCulloch v. Maryland, established the priority of national law over state law. The two cases were orchestrated by the Chief Justice of the Supreme Court during that time, John Marshall. Together, these milestone rulings have become part and parcel of democratic America. To fully understand the case of Marbury v. Madison, one may need to examine the French Revolution, wherein lies the rise of the Democratic-Republican political party.
