Essay Number 1 - AS Level Law There are three main types of criminal offences, which can be categorised as Summary, Inditable and Triable Either Way. Summary offences are the least serious type of criminal offence and involve incidents such as RTA (Road Traffic Accident). Magistrates always try these. Indiatable offences are the most serious type of criminal offence, which must be tried in front of a judge and a jury. These involve cases such as murder and rape. The third category of offences is called Triable Either Way. This is where the accused may select trial by a judge or jury or by the magistrates. Both Magistrates and the Crown Courts have the right to listen to criminal cases. Magistrates are often located in Towns and Cities, and each court will have a Magistrate (s), which hears the case.
