The role of the preliminary procedure in the enforcement of Community law 1. Introduction The European Community does not only needs rules, but also instruments to maintenance the rules. This maintenance is not only a matter of the Court of Justice of the European Community, but also of the national courts. Here fore the several Treaty's provide the possibility or obligation for the national courts to request for a preliminary ruling when they are confronted with the application of EC law. In this essay will only be looked at the role of the preliminary procedure of art. 234 (former art. 177) of the Treaty establishing the European Community as changed after the Treaty of Amsterdam (EC) in the enforcement of Community law.
