On 28 July 1997, a 24 year old man pleaded guilty in the Supreme Court of Nassau to two accounts of armed robbery and one attempted robbery; he was sentenced to two consecutive terms of 15 years imprisonment as well as flogging in two instalments. The sentence was imposed under Part II of the Criminal Law Act 1991. He appealed against the severity of his sentence to the Court of Appeal of the Commonwealth of the Bahamas, claiming that flogging infringed his right under article 17(1) and that it was not protected under article17 (2) or article 30(1) for that matter. The Court of Appeal granted him legal aid and held that the sentence was not unconstitutional and dismissed his appeal. Pinder now appeals to the Judicial...
