MODERN DEVELOPMENTS IN EQUITY OVER THE 20TH CENTURY During the period of 1258 there was many problems with common Law. The main being the way cases had to be started in the common Law courts. To go to court you had to obtain a document called a writ (before 1258 you could ask for a writ for any situation, Oxford provisions of 1258 stopped this). The person going to court would need to fit his problems into an existing type of writ. If it could not be done there would be a slim chance of attending court and getting justice. Some fictions were made up and altered to proceed the case but it was difficult to do this for the majority of cases. The only remedy the client would be liable for was damages.
