Planning Permission can be applied for retrospectively but even then, a favorable approval is not mandatory. Although Planning Law has not been created by statutes but by successive governments, it is a Civil law. An infringement of any Planning Permission already approved or carrying out of works with disregard to Planning requirements can lead the individual to committing a criminal offence. Works to the barn in question would require Planning Permission as defined by s.55 (1) TCPA 1990 because the works would be an operational development as defined in the Act: firstly '...the carrying out of building, engineering, mining or other operations in, on, over or under the land...' secondly '...the making of any material change in the use of any buildings or other land'.
