In R v. Dudley and Stephens (1884) 14 QBD 273, Lord Coleridge observed that: "Though law and morality are not the same, and many things may be immoral which are not necessarily illegal, yet the absolute divorce of law from morality would be of fatal consequence..." Critically consider these observations in the context of English criminal law. English criminal law deals with crime and the legal punishment of criminal offences. The Criminal Justice System operates with two purposes in mind. Firstly, it is intended to enforce social control by discouraging behavior that is harmful to others, punishments such as fines, injunctions, probation and imprisonment are designed to serve as a deterrent which aims to prevent this behavior from re-occurring. It is a system used by the government to maintain social control and administer justice. The government must ensure that they remain within the framework of laws that protect individual rights....
