Shaw Freedom of Assembly 'The fact that the protestors are desperately sincere and are exercising a fundamental human right must not lead us to overlook the rights of the majority.'1 In the absence of a written constitution, the freedom of assembly is protected in the same way as other freedoms and liberties in English law. That is to say, people are free to assemble to the extent that their conduct is not otherwise unlawful. There is no general right to hold open-air meetings in the UK, but that does not mean every meeting is unlawful. What the law in this area concerns itself with is the protection of the many while still upholding the rights of the few.
