Examine the Extent to which the Supreme Court Justices are Subject to Democratic Checks (June 2003) Checks on the Supreme Court mainly come from to sources, the President and Congress, but other checks exist as well. The president has checks over the Supreme Court in the nomination process and through criticisms of the court and its rulings. During the nomination process the President consults the American Bar Association (ABA) to give him/her a list of candidates that in their opinion would be suitable for a position on the Supreme Court. This has traditionally been the way but in recent years some presidents have gone elsewhere for a list because they feel that the ABA is too democratic. This means that this check is slowly depleting. Another check of the President during the nomination process is just the fact that he gets to nominate them.
