Law Essay 1) Civil disputes can be resolved in 4 main ways, without going to court. These ways include: * Mediation * Arbitration * Conciliation * Negotiation In mediation an impartial third party tries to get the disputing parties to come to an agreement therefore resolving the dispute. The mediator helps the parties clarify their needs, interest and legal rights. This agreement is not binding, this means that any of the parties can still go to court to change the agreement. This alternative can be used for disputes with neighbours, housing and business disagreements. In arbitration a neutral third party conducts a hearing, at the hearing the arbitrator listens to both side then makes a decision. This decision is binding, because this is a binding decision you cannot take your case to court after the arbitrator has made the decision. The arbitrator will usually be a member of the Chartered Institute of Arbitrators and often acts independently....
