Assignment 5.11 A.) Two months ago Spenders Ltd purchased machinery for their use in their factory from whiz electrics. The machinery cost £35,000 but is defective and has gone wrong several times. Spenders wish to claim compensation from whiz electronics. The claims to this court could be made in the magistrate's court. The magistrates deal with summary offences. As magistrates are not legally qualified, the clerk of the court assists them. However the magistrates are solely responsible for deciding the facts of the case and the sentencing of the defendant. The case can be heard in the county court under the small claims court. The process of using the county court is fairly cheap and relatively straightforward. The county courts deal with a wide range of civil cases and have been a success overall. The process used in the civil courts is laid out in the civil procedures rules 1999....
