Pearce v Governing Body of Mayfield School Commentary Pearce was a victim of verbal abuse from children that she taught at Mayfield School. The abuse rotated around her sexual orientation. She attempted to gain support from the school, however, apart from disciplining a few pupils in connection with one incident involving cat food being placed in her jacket, no other assistance was provided. During correspondences with a chairman it was stated that, 'you must of known that in making your position know publicly you risked comments, possibly even abuse, from adults and children'. The claimants' health suffered and she was forced to retire due to ill-health. The claimant under the sex discrimination act 1975 brought an action against the Mayfield School, claiming that she had been sexually discriminated against. The fist tribunal found that the nature of the abuse fell outside the boundaries of the 1975 Act, the issue progressed to...
