The education authorities (Glasgow City Council and Others) appealed against the tribunal's decision on the second issue, i.e. the section 1(3) defence. The education authorities did not appeal against the tribunal's decision on issue one, namely, the "like work " issue. Lord Johnston dismissed the appeal.
