To what extent is "Restorative Justice" the way ahead for the Penal System? "Restorative justice is a process whereby parties with a stake in a specific offence collectively resolve how to deal with the aftermath of the offence and its implications for the future". Marshall (19991) Restorative Justice is a new way of thinking about and responding to crime. For the past decade, especially, there has been an increasing interest in new approaches towards justice; which involve the community and focus more on the victim. Earlier studies conducted by Howard Zehr (1990), who was one of the pioneers leading the argument for restorative justice, highlighted three questions presented when taking a restorative approach: What is the nature of the harm resulting from the crime?
