Offences Against The Person Act 1861 Section 47 provides: ' Whosoever shall be convicted on indictment of any assault occasioning actual bodily harm shall be... [liable to punishment]' 1.1 Actus reus It requires proof of three elements, an assault, causation and actual bodily harm. 1.1.a Assault Common law assault requires proof that the defendant has caused the victim to apprehend immediate physical violence.
