Legal Methods & Legal Systems 2001/2002 "An effective criminal justice system needs to strike a balance between punishing the guilty and protecting the innocent." Discuss I am of the opinion that an effective criminal justice system should be capable of fulfilling both duties, to protect the innocent as well as punish the guilty. There should be a fine balance/equilibrium between both those aims. The system should be able to delver justice for all. The system should not be so afraid of the consequences of punishing the innocent or allowing the guilty to go free that it is unable to complete either function effectively or correctly. Neither should it be so intent on appearing to punish the guilty that it penalizes the innocent thus again failing to execute either duty.
