Assignment 1 In relation to the death of the passenger, Parveen and Joe are liable for manslaughter. There are two main kinds of manslaughter - voluntary and involuntary manslaughter. Voluntary Manslaughter covers the situation where a defendant has the necessary actus reus and mens rea for murder but is able to rely on either of the three defences: provation, diminished responsibility and killing in the course of a suicide part. The case of R v Atkinson [1985]1 is an example of voluntary manslaughter using diminished responsibility as a defence. The defendant stole alcohol and drank it with his friends who then burgled a house beating the 77-year-old occupant who later died of a fractured skull. The Court of Appeal dismissed the appeal saying that in the right state of mind and not being effected by alcohol he may not have done this.
