The defendants were building contractors refurbishing a block of flats. They sub-contracted the plaintiff to carry out the carpentry work for an agreed price of £20,000. The plaintiff began to run into financial problems, as the price he quoted for the work was too low. There was risk that they might not be able to complete the work; this would result in the defendants incurring a financial penalty for not finishing the refurbishment on time. The defendant offered to pay the plaintiff a further £10,300 if the plaintiff could complete the work on time, and this was accepted.
