Workwell Ltd are facing two disputes. One with Highroad plc and the other with Drainklear. Before any legal implications can be analysed it must be first proven that the agreements between both Highroad Plc and Drainklear, are in fact legal contracts. For these agreements to be defined as a contract six conditions must be satisfied. Workwell Ltd has invited bids for the drainage work. This is an invitation to treat and not an offer, but invitation to negotiate. The other party, Drainklear actually made the offer when they bided to do the work for £19,000. Workwell could then choose whether or not to accept it. This gives Workwell the flexibility to accept the best offer. Both parties have given consideration, as Drainklear has offered a service in return for payment in the form of money from Workwell.
