Obligations Assignment One 2002/03 Assessment 2 Chris Thomas This problem revolves around a main contract and a sub-contract, the modifications and proposed outcomes of each. I will take each separately and break them down to establish whether they are binding and how they affect Northern Builders. I will refer to Northern Builders as NB, East Kent Estates as EK and Shovelco as S. Although not chronological it is easier for me to first address the contractual obligations between NB and S. The original contract formed between the two parties is that NB promised to pay S £50,000 to survey and level the land. There is no problem with this contract as there is good consideration and therefore the promise is binding. However, it soon becomes apparent to S that the work will cost twice as much as they first expected and that they are in no position to fund the difference so they approach...
