George has a small ice-cream making business based in Newcastle. Recently he decided to re-locate to Manchester. He obtained a written estimate for the removal of all his ice-cream making equipment from Carry All Limited, a firm of removers. The estimate set out the terms and conditions upon which Carry All Limited was prepared to contract. One of the terms stated that: "Carry All Limited accepts no liability for any loss or damage caused to goods whilst in transit due negligence." George decided to accept the estimate and was then sent a written contract which he signed. The contract indicated that "...all the terms are as specified in our estimate." George's goods were loaded on to one of Carry All Limited's removal vans. The driver however, had a migraine attack whilst driving.
