Details of This Case Griffith plc agrees to carry Pitcher plc's goods on board Griffith's ship, 'The Good Sport', from London to Spain. Two bills of lading are issued both endorsed with the provision that 'cargo is carried at shipper's risk'. The cargo is described in the first bill of lading as '5 containers containing wooden garden furniture, liberty to carry on deck.' The second bill of lading referred to a consignment of 1,000 gallons of paint. En route to Bilbao, Spain, the 5 containers are washed off deck and the paint is damaged by sea water which seeps into the hold as a result of both a defective cooling fin and an air conditioner valve which has been left open during an occasional routine inspection carried out while the ship is at sea.
