First i would like to define the variuos terms of a contract. Now for there to be a binding contract, some elements must be present. These are, an agreement between the parties, which is usually shown by the fact that one party has made an offer and the other has accepted it, also the certainty as to the term of agreement and the capacity to contract, also to be considered is that there must be some form of consideration.
