I am very pleased to be able to help on both of these matters and my advice is as follows. I will firstly deal with the oral contract to which you entered with the farmer on the buying of land from him. On this affair I am going to advise you on the Requirements of Writing (Scotland) Act 1995. This Act states in Section 1 subsection2 that a written document will be required for - "(2)(a) the constitution of - (i) a contract or unilateral obligation for the creation, transfer, variation, or extinction of an interest in land;... (b) the creation, transfer, variation or extinction of an interest in land otherwise than by any operation of a court decree, enactment or rule of law;" Therefore...
