Prior to considering the legal positions of the parties involved it may be beneficial to defining what a contract is and how the law of contract would affect possible decisions made in court. In general, a contract is a legal agreement made between one or more parties. In order for a contract to be valid and therefore legally binding an offer must be made, this must be accepted and consideration must be exchanged and there must be an intention to create a legal relation. If the given problem was put towards the courts their aim would be to decide which party David, the dealer was liable to sell the DVD player to, if in fact either Vicky or Wayne were entitled to buy the DVD player. This is likely to be done using the approach favoured in law, defined by Professor Atiyah as 'reasoning forwards', i.e. looking for offer and acceptance...
