To determine whether or not the claimants can make a claim, we must decide whether the exclusion clause have been clearly incorporated into the contract, if so, has it been clearly constructed? Exclusion clauses can be incorporated in to a contract in three ways, by signature, notice or course of dealing. In the case of Lucy and Robert, they did not sign a contractual document, therefore the way to determine incorporation is to see if the existence of the clause have been given by notice to Lucy and Robert by the Salsa dance club at the time or before the contract was formed. It can be said that, the existence of the terms were incorporated from the case of Thompson V LMS Railway (1930).
