Contract Law This question deals with the law of contract and examines intent to create legal relations and consideration. Peter is seeking advice as to whether a legally enforceable contract existed between him and his wife with his parents. Contract law is categorised under civil law of obligations. A claimant can sue if a contract has not been carried out as agreed, in the terms of that contract. A court if acting in favour of the claimant will look to put the claimant in the position he would have been in if the contract had been carried out. For a contract to have existed there needs to have been in general an offer, an acceptance, and intent to be legally bound. Contractual obligations are based on the agreement of the contracting parties and are recognised by law, therefore a contract is an agreement that is legally enforceable.
