There are a number of issues that must be addressed. First of all whether Dotty's statement is a term of the contract or a mere representation, if it was deceitfully made, and whether the length of time that has elapsed since the purchase is significant. Also it must be determined whether Charlie's failure to discover the truth himself has any bearing. Finally these factors must be taken as a whole, to conclude whether Dotty is liable and if so, under which area, contract or tort.
