T Choitram International SA and others v Pagarani and others [2001] 2 All ER 493 Thakurdas Choitram Pagarani, a successful businessman who operated in the British Virgin Islands, wished to create a charitable foundation to which he would donate his estate after his death. Before doing that he had provided that both his first and second wife and children had enough to live a comfortable life. The wish of the donor (TCP) lead to a court case because after his death, certain formalities allowed his second wife and children to claim his estate by questioning the completion of his wish and claiming that he aimed it to be revocable. The Court of Justice and the Court of Appeal of the British Virgin Islands ruled in favour of TCP' s wife and children, which lead to the foundation appealing to the Privy Council.
