Rights and Freedoms - Unit 4 Each individual has certain rights in society. Some of these rights may be restricted by the torts of trespass, nuisance and defamation or by legislation. Example in the tort of nuisance we have the right to use our property as we see fit as long as it does not interfere with another persons rights to use and enjoy their property as they see fit. Defamation is the subject of a false statement about another person that injures another's reputation or good name. There are two ways in which defamation can take place either by libel or slander. Libel involves the creating of defamatory statements in a written or printed standard. Slander involves the making of defamatory statements by a passing representation usually by mouth (orally).
