Discuss either in the relation to the actus reus or the mens rea of theft, the problems associated with that particular aspect of the law. The actus reus of theft consists of three elements. These three elements are: 1) Appropriation 2) Of property 3) Belonging to another Appropriation means doing something with property that only the owner has the right to do. This could be keeping the property, destroying it or even selling it. This is further explained in section 3(1) of the 1968 Theft Act: 'Any assumption by a person of the rights of an owner amounts to an appropriation, and this includes where he has come by the property (innocently or not) without stealing it any later assumption of a right to it by keeping or dealing with its owner.'
