BAIL ESSAY The next step to be taken after the defendant has been prosecuted, is to decide whether he should be detained in custody or released on bail pending the trial of the defendant. Bail is the release of the defendant subject to a duty to surrender to custody at the appointed date. They will remain on bail 6 weeks until awaiting a sentence. Before the court decide whether to grant bail which is governed by "The Bail Act 1976", it must be taken into account whether the defendant may interfere with the witness, or if released they may not return to court, it must also be taken into account whether the defendant is likely to commit a further offence while on bail. The court will also look at the defendants character and past record, the seriousness of the offence, or whether the defendant has previously kept to the terms of bail,...
