Access the effectiveness of the lay magistrate's appointment process? On average about 1500 new lay magistrates are appointed each year and according to the figures of 2005 there are currently 28,253 lay magistrates in England and Wales. These appointments are made by the Lord Chancellor (Lord Faulkner) and the Secretary of State for Constitutional Affairs. The Lord Chancellor relies on recommendations from the local advisory committees (Usually current or ex justices of the peace and often lord lieutenant of the county is the chairman of the committee) but this method has become heavily criticised. Certain people are excluded from being appointed such as police officers, traffic wardens and members of the armed forces or any one whose work whose work would interfere with there work to perform their duty as a magistrate. Others that also cannot become a magistrate are people whose disability doesn't allow them to perform their duties...
