The legal challenge in this case, is towards a new local authorities policy on granting planning permission on new factory outlets. This it promised in its election manifesto. There is objection from local residents, who feel they are affected by the new policy. James objects on the principles that there was no prior consultation; there will be nuisance from noise and a fall in residential property values. We need to address James's rights in public and private law and the procedure he needs to go through to enforce these rights. We also need to address James's twin role as a member of a local movement/pressure group; 'Save Our Green Space' and as a member of the adjacent housing estate to where the factory outlets will be.
