Property Law: 'Possession is nine points of the law'. One often hears the maxim 'possession is nine points of the law' used in trying to demonstrate that possession is tantamount to ownership. Whether this is true or not remains to be seen but it must be pointed out at this early stage exactly what is the definition of possession. In legal terms, the word possession is divided threefold: actual, constructive and symbolic. Actual possession is what the everyday person would think of as the meaning. In simple terms, it means that you alone have physical control. Constructive possession means that a person may own something but another person may be in temporary possession of this thing. The owner is said to have constructive possession as he can usually take possession back when he desires.
