Immigration and Race Relations Law Coursework The case and the courts decision This case involved the issue of the system of control of entry of Commonwealth citizens and provisions set out in the Commonwealth Immigrants Act 1962, which failed to achieve its main aim that Parliament intended. The reasoning for the creation of the act was to reduce the numbers of Commonwealth immigrants who did not satisfy the set conditions to enter the country, but did allow for those with employment vouchers, students and dependents the admission to enter the United Kingdom. The defendant in the case was charged with conspiracy to evade the control of immigration officers but the court decided that there had been no offence committed by him as the acts were neither prohibited by Act of Parliament or at criminal law.
