The development and growth of the Internet over the last two decades has seen a number of academic debates arising, which concerning both the nature of state sovereignty and the limits of its jurisdiction. One such area is intellectual property right's and the legal mechanism of protection (copyright, patent, trademark) used to enforce the owners property rights. This paper will look at the social, political and economic aspect of this complex phenomenon, and show that present legislation under the 73 TRIPs articles of the WTO treaty, has shifted the intellectual property rights heavily in favour of the corporate sector. The paper will first look at both the arguments for and against intellectual property. This allows the proposed solutions and philosophies contained within both the East and West coast schools to be better evaluated.
